Herbert C. (Lee) Phillips
Town's attorney has extensive experience in municipal law

Buena Vista's new town attorney, Herbert C. (Lee) Phillips, was drawn to the mountains to work and recreate after years of practicing municipal law in Denver with the firm of Hayes, Phillips, Hoffmann & Carberry, P.C., he said.

Phillips was one of the founders of the firm started over two decades ago specializing in municipal law and he has practiced municipal law for over 30 years. In 2005, wanting to relocate to the mountains where he had built a home in 1995, Phillips opened the firm's Fairplay office that now provides legal services as general counsel for not only Buena Vista, but also to the City of Cripple Creek, the Towns of Alma and Fairplay and Park County as well as various community associations and private clients.

Phillips, who came on board in August, said one big issue for Buena Vista is development and as in all other places, water is a critical issue. One recently completed big project was the acquiring of the airport terminal.

Prior to moving to the mountains, Phillips served as city or town attorney for a number of municipalities in the Denver area and mountain areas. These municipalities and towns remain clients of the firm, he said. Phillips said he has also been called in as special counsel in complicated or novel matters for a number of other Colorado municipalities over the years.

Phillips and his firm have argued several landmark cases in Colorado appellate courts on issues such as land use, eminent domain, police power, takings, governmental immunity, civil rights, initiative and referendum, Taxpayers' Bill of Rights (TABOR) and annexation. They have extensive litigation experience in all areas of local government law that may involve litigation.

He completed a bachelor's degree at the University of Colorado, Boulder, in 1975 and juris doctorate degree from University of Denver in 1978. He was admitted to the bar in 1978. He is also a speaker and author.

As a regular visitor to Buena Vista - fly-fishing the Arkansas River north of town, backpacking and hiking in the Collegiate Peaks and buying plants for his home at the nursery in town - he was very familiar with Buena Vista, he said. He also enjoys fowl hunting with his dog.

Phillips' wife, Robin, is the Park County Public Health director. Two children are living at home, Jordan, a senior in high school; and Madison, a sophomore in high school. Daughter Patricia, 28, is a patient navigator for the American Cancer Society.
